Terms & Conditions

Credit Card Payments will be processed through the PayPal portal under Crossman Software. You don't have to be a PayPal member to pay with your credit card using this service.

Returns on Software

All software sales are final. Third party software is subject to the respective provider return policy. MacPOS software is available for download as a Trial version.  It is the same software as the production version with limitations.  Please try our software before purchase.

Non-defective Product Returns

Only merchandise in factory sealed boxes may be returned to Macpos.com or an authorized third party for a full refund or credit. This credit or refund may be subjected to any applicable shipping and handling charge. Merchandise returned in open boxes will be charged a minimum 20% restocking fee plus any applicable shipping fees. Additional fees may apply if a product is returned to Macpos.com and not the provider. No returns for refund or credit are accepted without an authorized RMA number. No returns are accepted after 15 days. There are no returns accepted on software as all sales are final. Most all of the software sold by us has a trial version available for evaluation and we highly recommend you indeed try it before you buy it.

DOA

If a product is DOA (Dead On Arrival), out of box failure, or fails during the manufacturer's DOA period, our Customer Service Department will arrange for a replacement within the guidelines of the manufacturer's warranty and DOA policy.

Returning Defective Products

All products returned must have a valid Return Material Authorization (RMA) number issued from MacPOS.com. To receive an RMA number please contact. Any product received without a valid RMA number may be be refused at our discretion. Please return all products complete with any boxes, manuals, warranty cards, cables and anti-static packaging. All manuals, warranty cards, etc., must not be written on or defaced to be eligible for full credit.

We recommend double boxing all returns to avoid damage to the manufacturer's box. Write the RMA number on the outer box. Do not write on the product box. Returns must be shipped freight and insurance pre-paid to the address on our contact page or that we provide.

Restocking fees

MacPOS.com may charge for any items missing from your authorized return. We may at our discretion charge a minimum 20% restocking fee to cover processing costs for returns that are not complete and not in a manufacturer's minimum acceptable condition.

Shipping and handling fees

Macpos.com will not reimburse or refund any shipping and handling fees incurred with delivering any provider products.

No refunds for remote assistance or installation services after these services have been provided.

 

By using and installing a Crossman Software product, you are bound by the terms of the license agreement below.

Software License Agreement

This Agreement made and entered into by and between you and Crossman Software. (hereinafter referred to as “CS”) stipulates the terms and conditions pertaining to the licensing of the software. Please read this Software License Agreement ("Agreement") carefully before installing or using the software and accompanying data (hereinafter referred to as "the Software"). By installing the Software, you are agreeing to be bound by this Agreement. If you do not agree to the terms of this Agreement, you are not entitled to install the Software.
References to "Software" in this Agreement include any accompanying documentation furnished by CS.

1. Permitted License Uses

During the term of this Agreement, CS grants to you a nonexclusive, non-transferable license to use the Software for your own use subject to the terms and conditions of this Agreement. Except for this limited license, CS reserves all other rights in the Software. The rights granted herein are limited to CS's intellectual property rights in the Software. Only for the purpose of using a CS product, you may install the Software on a computer that is directly or via a local area network connected to the CS product.

2. Restrictions on Permitted License Uses

You may not reverse engineer, disassemble, or decompile with regard to the Software or otherwise attempt to discover the trade secrets in the Software. In addition, you may not copy, reproduce, alter, modify or create derivative works of the Software or any part thereof. Notwithstanding the provision above, you may not alter the binary data (object code) of the part of source code disclosed out of the Software. You may not sublicense, transfer, rent, lease, or redistribute the Software to a third party. CS is not obligated to provide any maintenance, technical or other support for the Software.

3. Intellectual Property Rights

Copyrights, patents and any other intellectual property rights in the Software shall belong to CS or CS's licensors. This is a license, not a sale.

4. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice from CS if you fail to comply with any term(s) of this Agreement. Upon the termination of this Agreement, you shall cease all use of the Software and destroy all copies, full or partial, of the Software.

5. Disclaimer of Warranties

You expressly acknowledge and agree that use of the Software is at your sole risk and that the entire risk as to satisfactory quality, performance and accuracy is with you. The Software is provided "as is", with all faults and without warranty of any kind, and CS and CS's licensors hereby disclaim all warranties and conditions with respect to the Software, either express, implied or statutory, including, but not limited to, the implied warranties and/or conditions of merchantability, of satisfactory quality, of fitness for a particular purpose, of accuracy, of quiet enjoyment, and non-infringement of third party rights. CS does not warrant against interference with your enjoyment of the Software, that the functions contained in the Software will meet your requirements, that the operation of the Software will be uninterrupted or error-free, or that defects in the Software will be corrected. No oral or written information or advice given by CS or CS authorized representative shall create a warranty. Should the Software prove defective, you assume the entire cost of all necessary servicing, repair, or correction.

6. Limitation of Liability

To the extent not prohibited by law, in no event shall CS be liable for personal injury, or any incidental, special, indirect or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption or any other commercial damages or losses, arising out of or related to your use or inability to use the Software, however caused, regardless of the theory of liability (contract, tort, or otherwise) and even if CS has been advised of the possibility of such damages. In any event, CS shall not be liable for any damages, in the aggregate, regardless of type or kind, whether in contract or tort, in excess of the actual license fees, if any, paid by you for the Software in the three (3) months immediately preceding the first event giving rise to liability.

7. Governing Law and Severability

This Agreement will be governed by and construed in accordance with the laws of the United States. If for any reason a court of competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the remainder of this Agreement shall continue in full force.

8. Third-party Software

If the whole or part of the Software includes any third-party software or intellectual property right including, but not limited to, open source software (hereinafter referred to as the "Third-party Software"), you shall comply with the terms and conditions of the license granted by the third party related to your use of the Third-party Software. In no event shall any of the provisions of this Agreement be construed as a limitation on the right of the third party to enforce each and every terms and conditions of the license. In no event shall CS be liable for any limitation on the use of the Software, which might be imposed by enforcement of the license by the third party. If the Software includes the Third-party Software, you will find the particulars thereof including the licensing conditions in the "Software License Agreement”. All Third-party Software is provided as-is, with all faults and without warranties of any kind.

9. Compensation for damages

If you fail to comply with any term of this Agreement, CS has the right to terminate this Agreement and any other agreement made with you and claim compensation for damages suffered resulting from such termination.
